Given the successful recruitment of UPC Judges announced in October 2022, the commencement of the UPC is currently expected on April 1st 2023 with the Sunrise period beginning on January 1st 2023.
The Sunrise Period will provide a period of three months for patent holders to decide to opt-out their existing European patents. Patent owners need to take action now to ensure they understand the ramifications and actions required to be taken in respect of their existing portfolios.
